Remove Judge Chutkan from Trump Case

Resolution 2023-11C - The Alameda County Republican Party Central Committee, resolved:

Whereas:

  • the Code of Conduct for United States Judges serves as an ethical canon for all federal judges to abide by, guiding them on their duties on and off the bench.
  • Judge Chutkan’s comments and activities on and off the bench violate all 5 canons of the Code of Conduct for United States Judges; namely,
    • calling into question the integrity and independence of the judiciary;
    • presenting impropriety and the appearance of impropriety;
    • failing to perform the duties of the office fairly, impartially, and diligently;
    • engaging in extrajudicial activities inconsistent with the obligations of the office; and
    • engaging in political activity,"
  • public comments by Judge Chutkan from the bench, raise significant doubts about her impartiality and thus ability to handle the case of Donald J. Trump, the candidate who is now, and has been leading substantially in all polls for the Republican nomination for President in 2024. 
  • Judge Chutkan has twice issued a gag order, that has temporarily been put on hold since it has been appealed by Trump to a higher court, attempting to bar President Trump from exercising his First Amendment right of free speech that would deny Trump AND others from making any public statements that criticize the Special Counsel or his staff who are prosecuting this case.
  • Judge Chutkan, on October 31, 2023 went so far as to deny the American Civil Liberties Union (ACLU), no friend of Trump, from filing a brief in the case attacking the gag order as an unconstitutional infringement of Trump's first amendment rights
  • these actions and statements by Judge Chutkan deny the basic principle of justice in the United States, that all people when charged are considered, "innocent till proven guilty," and not "guilty till proven innocent."

Therefore:

The Alameda County Republican Party Central Committee Calls For:

  • Removal of Judge Chutkan from this case
  • President Trump's Constitutional Rights to be Fully Respected and Upheld.

Oppose Fentanyl at All Sources

Resolution 2023-11B - The Alameda County Republican Party Central Committee, resolved:

Whereas:

  • Fentanyl, which was originally developed in Belgium in the 1960’s as an opioid to relieve chronic pain, has become a nationwide crisis.
  • Fentanyl is causing massive destruction to communities all across the United States
  • 107,000 Americans overdosed last year and two-thirds of that figure are estimated to be caused by Fentanyl.
  • Fentanyl precursor chemicals originate in China, then shipped to Mexico to create a final product.
  • Fentanyl, due to its incredibly high potency, as well as its chemical makeup, is incredibly affordable and, unfortunately for U.S. border security, easy to traffic,
  • Fentanyl is approximately 100 times more potent than morphine and 50 times more potent than heroin as an analgesic.
  • in fiscal year 2023 alone, CBP (Border Patrol) has seized over 20,000 pounds of Fentanyl coming across the Southwest Border – enough to kill over 4.6 billion people.
  • Fentanyl mixed with Xylazine is an emerging threat in the U.S., because Xylazine, an animal tranquilizer, can be life-threatening and is especially dangerous when combined with opioids like Fentanyl.
  • internationally, the United States needs to continue to bolster strong relations with China and Mexico in order to protect human lives.

Therefore:

The Alameda County Republican Party Central Committee demand that the Biden Administration

  • close the U. S. Southern Border,
  • bolster strong relations with China and Mexico, and
  • hold all financial institutions, hedge funds, private equity firms and multinational corporations accountable for the crime of money laundering to stop the massive influx of deadly Fentanyl.

Oppose Human Trafficking

Resolution 2023-11A - The Alameda County Republican Party Central Committee, resolved:

Whereas:

  • human trafficking is the 2nd largest illicit industry in the U.S., 2nd only to the drug trade.
  • California consistently ranks number one in the nation in the number of human trafficking cases reported to the National Human Trafficking Hotline
  • human trafficking is a form of modern-day slavery, in which human beings are controlled, exploited and killed for profit.
  • online websites have enabled traffickers to recruit victims and customers in large numbers.
  • young children, of unknown numbers, are exploited by traffickers who force them to sell their bodies for the trafficker’s financial gain, and when they are no longer a financial asset, they are sold for body parts.
  • drugs are bought and sold in one single transaction; human beings, however, can be sold over and over again, and some victims report being forced to engage in commercial sex with up to fifty “clients” in a single day.
  • On September 25, 2023, California Senate Bill 14, was signed into law, having sex trafficking a serious felony, making the crime a strike under the Three Strikes law.
  • the actual number of illegal immigrant children, who have entered the United States illegally at our southern border, is unknown, and they are unaccounted for and extremely vulnerable to human trafficking.

Therefore:

The Alameda County Republican Party Central Committee

  • will pursue the fight against human trafficking by providing educational outreach and asking that all financial institutions, hedge funds, private equity firms and multinational corporations be held responsible for the laundering of funds from the illegal trafficking trade.
